Who needs Congress - part 3 - my column in the Boyne City Gazette; Lawsuirts filed against the Democrat Party on certifying Obama as eligible; Obamacare against married couples; Occupy Phoenix puts out document questioning goodness of cops, and saying that any cop killer may have been the good guy

Tyranny is defined as the arbitrary or unrestrained exercise of power.  As an Obama spokesman said, “There are things he can do without Congress, and he will do them.” Obama recently asked appointees to” identify all those areas in his newest Jobs Bill in which they can act administratively without additional congressional authorization and just get it done."
 
1)       President Obama has at least 45 czars, all protected by the Freedom of Information Act from disclosure of their activities, or oversight by Congress.
2)      President Obama signed an executive order authorizing the transfer of all 172 Guantánamo detainees to the next chief executive of the United States of America.  Obama had pledged to close Gitmo because it is immoral to treat foreign enemy combatants in mean ways, and yet he directed the killing of an American citizen (al-Awlaki) without the benefit of either imprisonment or military tribunals.  This action was decided by a secret “kill panel” whose decisions are not necessarily published.
3)      Any Secretary of Health and Human Services is empowered by Obamacare to decide with no Congressional vote what care will and will not be covered and what new regulations will be mandated.  This leads to rationing through so-called Death Panels.
4)      Obama’s Agriculture Secretary Tom Vilsack recently told members of the National Restaurant Association that Americans need to “adjust their tastes so that they like the kind of food the government believes they should eat—and we have to make sure that what we do is create the appropriate transition.”  So it is now government’s job to decide for us what we will eat.  Our US Senate recently voted to stop Obama’s proposal to limit the amount of potatoes served on school lunch lines.
5)      Our President recently launched “Attack Watch” on his website, a new vehicle to have citizens report to him those fellow citizens who say mean things about him. 
6)      The American Cancer Society has noted, "The federal government has never before attempted to define what constitutes essential medical benefits for Americans with private insurance."  And yet they are now planning, through Obamacare mandates, just what private health insurance policies may cover.
7)      The Food and Drug Administration just announced a coming ban on over-the-counter inhalers for asthmatics, as part of an agreement signed by the U.S. and other nations to stop depleting the ozone layer.  So sorry, asthmatics.
8)      The Administration admits to 219 pending major regulations from Obamacare, the Dodd-Frank financial law and others, each to cost more than $100 million per year.  The President has personally identified the “Big Seven” regulations which would each impose burdens of over $1 billion per year.
9)      Department of Health and Human Services is demanding that insurance companies submit detailed health care information about their patients, endangering our privacy.
10)  Our President threatened to make the entire state of Texas a no-fly zone if that state criminalized the TSA screenings.
11)  The EPA is asking taxpayers to fund up to 230,000 new government workers just to process all the extra paperwork, at an estimated cost of $21 billion.
12)  A bill has been offered which would seal the Presidential records of Obama, just as his college records have been sealed.
13)  Hundreds of animals are about to be added to the Endangered Species list, even disrupting the building of the fence on the Mexican border.
14)  The extra paperwork and nearly $10,500-per-employee compliance costs are far from the only regulatory hurdles from government regulations over the trucking industry.
15)   81,205 pages of regulations are in place to improve farming.  Look for the UN Agenda 21’s “sustainable development” as key words.
16)  Deputy U.S. Attorney General James Cole says Obama has decided to “pull back all training materials used for law enforcement and national security communities, in order to eliminate all references to Islam that some Muslim groups have claimed are offensive.”
17)  Interagency Working Group on Food Marketed to Children has mandated new rules that will cost the food industry more than $28 billion in revenues and manufacturing in just its first year, denying to Congress the report required prior to enactment.

 The Liberty Legal Foundation has filed a pair of lawsuits in state and federal courts that don't ask anything about Obama's birth or for any determination from the court about his eligibility. Or his birth certificate, for that matter.

Instead, they name the national Democratic Party as a defendant, and ask the court to enjoin officials there from certifying that Obama is eligible for the office for the 2012 election.
"This complaint does not request or require this court to find that President Obama is not qualified to hold the office of president of the United States. Instead, this complaint is directed toward defining the term 'natural-born citizen' under the Constitution of the United States, and toward negligence or intentional misrepresentations of the Democratic Party.
"This complaint requests this court to affirm the Supreme Court's definition of 'natural-born citizen' as 'all children born in a country of parents who were its citizens."
"This complaint does not request any injunction against any state or federal government official. Instead this complaint asserts that the private entity, Defendant Democratic Party, intends to act negligently or fraudulently in a manner that will cause irreparable harm to the plaintiffs, to the states, and to the citizens of the United States."
It continues, "Because Mr. Obama has admitted that his father was not a U.S. citizen, and because this fact has been confirmed by the U.S. State Department, any reasonable person with knowledge of these facts would doubt Mr. Obama's constitutional qualifications. Therefore, any representation by the Democratic Party certifying said qualifications would be negligent, absent further evidence verifying Mr. Obama's natural-born status.
"Plaintiffs further request an injunction prohibiting the Democratic Party from making any representation to any state official asserting, implying, or assuming that Mr. Obama is qualified to hold the office of president, absent a showing by the party sufficient to prove that said representation is not negligent."

Fox News reports: The law includes generous subsidies for the uninsured so they can afford to buy coverage in the new insurance exchanges that are part of the legislation.
But several analysts told Congress Thursday the nature of the subsidies has an odd effect.
"The way this bill is structured, there are disincentives for women to marry and disincentives for women to work," said Diana Furchtgott-Roth, a senior fellow at the Manhattan Institute for Policy Research. "And for a bill that's supposed to make Americans healthier, these disincentives are truly startling."
Critics say that beginning in 2014, Americans will find it more advantageous to stay single than marry because it will be easier to afford health coverage.

The Blaze reports: Yesterday, the Arizona Counter-Terrorism Information Center (ACTIC — a division of the Arizona Dept. of Public Safety) released a bulletin announcing the chilling document that seems to endorse and justify the killing of law enforcement officers.
Copies of the “informational” letter were apparently left on a table with other documents to “educate” protesters at Occupy Phoenix. A bulletin from the ACTIC notifies officers of the document, but says that no credible threats against law enforcement official have been uncovered (yet its investigation continues).

The AP reports: The House voted Monday to exclude U.S. airlines from an emissions cap-and-trade program that the European Union plans to impose on all airlines flying to and from the continent beginning next year.
With the legislation, which passed by voice vote, lawmakers joined the airline industry and the Obama administration in opposing the EU Emissions Trading Scheme scheduled to go into effect on Jan. 1. The Washington Post reports: The Obama administration is wrestling with the thorny question of whether scientists should inject healthy children with the anthrax vaccine to see whether the shots would safely protect them against a bioterrorism attack.
The other option is to wait until an attack happens and then try to gather data from children whose parents agree to inoculate them in the face of an actual threat.
A key working group of federal advisers in September endorsed testing, sparking objections from those who consider that step unethical, unnecessary and dangerous. The Chicago Tribune reports: Controversial Nation of Islam leader Minister Louis Farrakhan condemned the killing of Libyan leader Moammar Gadhafi on Tuesday, warning that America and other Western powers will soon face severe consequences for their support of the uprising that led to the dictator's death.

"I know something of the good of Moammar Gadhafi that made me to love him as a brother and to feel a great sense of loss at his assassination," Farrakhan said during a two-hour interview with radio host Cliff Kelley on WVON-AM.
Chicago's Mosque Maryam, the Nation of Islam's international headquarters, was purchased 40 years ago with a $3 million loan from Gadhafi, but Farrakhan said his admiration of Gadhafi was not tied to Gadhafi's money or power.
Farrakhan acknowledged that Gadhafi had killed people, but he said all other world leaders, including President Barack Obama, are responsible for the deaths of others.
"Did he kill people? Well, hell, did our president kill people? Talk back to me!" Farrakhan said, prompting some of his supporters to say, "Yes," in reply.
"You have made your president an assassin, that the only value that he has now is that he was responsible for the death of (al-Qaida leader) Osama bin Laden," Farrakhan said, his voice rising. "He was captured without a weapon. He should have been brought to America, put on trial for the American people to see this man. Jewish World Review opines: T he worst fears about Obamacare are now being realized in a decision on Monday by the Medicare Payment Advisory Commission (MPAC) established by the law to supervise $500 billion in Medicare cuts. MPAC, whose decisions have the force of law, has voted to impose drastic pay cuts on all doctors under Medicare and, by extension, under Medicaid (which tends to follow suit). The Petoskey News Review reports: RICHMOND, VA (WTVR) - The Richmond Tea Party is asking the city of Richmond for its money back. They say they're not happy to hear that Occupy Richmond protesters get to stay in Kanawha Plaza - for free.
In April, the Richmond Tea Party held a Tax Day Rally in Kanawha Plaza. They say before they could use the city venue they were charged nearly $10,000 and had to comply with a series of usage forms and procedures.
Colleen Owens, a spokesperson for the Tea Party, says it's obvious the Occupy demonstrators are not being held to the same standard. David Limbaugh opines: Back when Obama was trolling for illusory savings to manipulate Congressional Budget Office scorekeepers into decreeing that Obamacare would be revenue-neutral, he proposed the ingenious scheme whereby the federal government would subsume 100 percent of the student loan industry and eliminate evil private-sector profits going to "middlemen."

By calculating $60 billion in savings over the next decade, Obama gleefully inflated student loans by $40 billion and boasted that he still had $20 billion left over to count toward reconciling the balance sheet on his grossly over-budgeted national health care bill.
Obama smuggled this student loan legislation into the Obamacare bill because it probably never would have otherwise attracted the 60 needed votes to pass on its own. Such relatively small-potatoes legislation, by itself, wouldn't have supported the bribes Obama used to cram through Obamacare.
You don't need to be a math wizard to understand that this is just a slick way of forcing taxpayers to take a bigger hit by increasing the number of loans that will never be fully repaid, yet another redistribution of wealth from our Marxist in chief.  [I heard on Fox News that this could mean that a student, who signed a contract to get his loan, may owe over $200,000 and end up paying less than $30,000.

Business Insider reported: Stephen Lerner, [former head of SEIU] said that unions and community organizations are, for all intents and purposes, dead. The only way to achieve their goals, therefore--the redistribution of wealth and the return of "$17 trillion" stolen from the middle class by Wall Street--is to "destabilize the country." 
The plan is designed to destroy JP Morgan, nuke the stock market, and weaken Wall Street's grip on power, thus creating the conditions necessary for a redistribution of wealth and a change in government.
The former SEIU official, Stephen Lerner, spoke in a closed session at a Pace University forum last weekend.

Lerner's plan is to organize a mass, coordinated "strike" on mortgage, student loan, and local government debt payments--thus bringing the banks to the edge of insolvency and forcing them to renegotiate the terms of the loans.  This destabilization and turmoil, Lerner hopes, will also crash the stock market, isolating the banking class and allowing for a transfer of power.
Lerner's plan starts by attacking JP Morgan Chase in early May, with demonstrations on Wall Street, protests at the annual shareholder meeting, and then calls for a coordinated mortgage strike.
Lerner also says explicitly that, although the the attack will benefit labor unions, it cannot be seen as being organized by them. It must therefore be run by community organizations.
Lerner was ousted from SEIU last November, reportedly for spending millions of the union's dollars trying to pursue a plan like the one he details here.
He said, "There are actually extraordinary things we could do right now to start to destabilize the folks that are in power and start to rebuild a movement.'

NY Post reports: The Occupy Wall Street volunteer kitchen staff launched a “counter” revolution yesterday -- because they’re angry about working 18-hour days to provide food for “professional homeless” people and ex-cons masquerading as protesters.
For three days beginning tomorrow, the cooks will serve only brown rice and other spartan grub instead of the usual menu of organic chicken and vegetables, spaghetti bolognese, and roasted beet and sheep’s-milk-cheese salad.

The Baltimore Sun writes: The Obama Administration announced it will accelerate changes in the federal loan program to make it easier for certain students to repay their loans.
Students enrolled in the Income Based Repayment Plan will have their payments capped at 10 percent of discretionary income starting next year, and any remaining balance after 20 years will be forgiven.  The Income Based Repayment Plan has been available since 2009 and has limited monthly payments to 15 percent of discretionary income with remaining debt is forgiven after 25 years.

Free Republic reports: A proposed revision to Freedom of Information Act rules would allow federal agencies to lie to citizens and reporters seeking certain records, telling them the records don’t exist.
The Justice Department has proposed the change as part of a large revision of FOIA rules for federal agencies. Specifically, the rule would direct government agencies who are denying a request under an established FOIA exemption to “respond to the request as if the excluded records did not exist,” rather than citing the relevant exemption.

But last week, we had a separate vote on a part of the jobs bill that would put 400,000 teachers, firefighters and police officers back on the job, paid for by asking people who make more than $1 million to pay one-half of 1 percent in additional taxes. For somebody making $1.1 million a year, that’s an extra $500. Five hundred bucks. And with that, we could have saved 400,000 jobs.
As every Corner reader who graduated from 4th grade determined immediately upon reading the above quote, one half of 1 percent of $1.1 million is $5,500, not $500. But, hey, even though he said it three times, cut the president some slack — he’s off only by about factor of ten.
But even if the president meant to say $5,500, his math continues to pose some challenges. According to the IRS, a total of 235,413 taxpayers earned more than $1 million last year. If each “was willing to pay $[5,]500 extra to help the country,” that would generate only $1.3 billion in revenue — approximately what the federal government spends every three hours. Who need Congress? - part 2 - My Boyne City Gazette column

I continue to chronicle the many ways in which this  Administration is passing new laws and regulations without the input and votes of Congress.  It is as if our "Constitutional Professor President never studied the Constitution, wherein Congress passes the bills and gives them to the President to sign into law..


1)  The Super-Committee on Debt was endorsed by our President even though it countermands the Constitutional mandate that laws are to be written in the House, passed through the Senate, and vetoed or signed into law by the President.  Congress is ceding its normal powers for the sake of expediency and bipartisanship.
2)  The Department of Energy was awarded Stimulus funds for green energy companies. President Obama rushed through taxpayer “investment” of $535 million in solar-power company Solyndra just in time for a photo op, even after being told that the company was not ready to be a viable enterprise. He later restructured the debt, assuring that private Obama-donor investors will receive their money in the event of default before we the taxpayers will be paid.  The company is now bankrupt, and may have violated terms of its taxpayer-paid subsidy.
3)  A waiver was granted by the FCC to LightSquared, a company whose product would interfere with military GPS.  An Air Force General as well as the director of the National Coordination Office for Space-Based Positioning, Navigation, and Timing testified that the White House asked them to alter their testimony to Congress regarding the company, which is funded by a major Obama donor. Obama himself invested $100,000 in this company in 2005 when it carried a different name.
4)  Obama’s Executive Order – “Establishing a Coordinated Government-wide Initiative to Promote Diversity and Inclusion in the Federal Workforce” – was mandated even though, according to the Office of Personnel Management, federal employees are currently underrepresented by whites and over-represented by blacks, Hispanics, Asians and American Indians in relation to their numbers in our country.
5)  Executive Order 13575 - Establishment of the White House Rural Council – ties directly to the UN’s Agenda 21 of 1992 and is crucial to achieving a “sustainable world” – “to create more sustainability and green energy.” Obama’s Department of Commerce declared that the agency could implement 67% of their mandates without the vote of Congress.  Government would then control and facilitate rural economic development.  Look for the key UN word “Sustainability” in your local planning documents.
6)  Obama’s Food Safety Modernization Act in the Omnibus Bill authorized millions in spending on “sustainable” agriculture and development in America. NYC’s Mayor Koch has declared that “government’s highest duty is to push healthy foods on the citizenry.”
7)  President Obama’s Executive Order 13547  Stewardship of the Ocean, Our Coasts, and the Great Lakes further extends federal power, embraces global governance, diminishes the rights and privileges of individuals and brings the United States into compliance with  UN Agenda 21, Chapter 17.6 which says: Each coastal State should consider establishing, or where necessary strengthening, appropriate coordinating mechanisms for integrated management and sustainable development of coastal and marine areas. …
8)  The Obama administration has set up a new National Ocean Council to convince the Senate to ratify the treaty Convention on the Law of the Sea.  Rejected by Ronald Reagan in 1982, and by our Senate in 2000 and 2004, the treaty is once again being promoted. If passed, the treaty would give the UN the power to regulate activities within our territorial boundaries and to levy taxes via royalties and application fees of $250,000, without providing one bit of new benefits to the United States.  The UN’s agenda is taking Americans money away from them to support the rest of the world.
9)  Obama’s Department of Justice is suing the Boeing Company for daring to build and operate a new plant where unions are not required to be involved.
10)   New Hampshire just cut off funding for abortions in their state. The Department of Health and Human Services stepped in to fund those Planned Parenthood abortions.
11)  Attorney General Eric Holder is promoting redistribution of our wealth to the UN to fight terrorism as well as the trying of terrorists in civilian courts, without the input or vote of Congress. 
12)  President Obama violated the War Powers act by entering a war in Libya without an Act of Congress, then dares to call it a kinetic activity.
13)  Obama’s Senior Advisor Valerie Jarrett states: “The point of government is to give people a livelihood so they can provide for their families”.

When will enough of this be enough?
 

The latest attempt: using the mantra of "We Can't Wait" (for Congress to do their constitutional duty].  The Obama administration has been working with the Federal Housing Finance Agency, the regulator for Fannie Mae and Freddie Mac, to find ways to make it easier for borrowers to switch to cheaper loans even if they have little to no equity in their homes.  [When any of these new mortgages go bankrupt, it will once again be the American taxpayer who takes the hit]http://www.reuters.com/article/2011/10/24/us-obama-economy-idUSTRE79N0J920111024

Yahoo News writes: The Obama administration is taking steps to extend new federal protections to a list of imperiled animals and plants that reads like a manifest for Noah's Ark — from the melodic golden-winged warbler and slow-moving gopher tortoise, to the slimy American eel and tiny Texas kangaroo rat.
Compelled by a pair of recent legal settlements, the effort in part targets species that have been mired in bureaucratic limbo even as they inch toward potential extinction.
With a Friday deadline to act on more than 700 pending cases, the U.S. Fish and Wildlife Service already has issued decisions advancing more than 500 species toward potential new protections under the Endangered Species Act.
Also among species that advanced for further consideration are 35 snails from Nevada's Great Basin, 82 crawfish from the Southeast, 99 Hawaiian plants and a motley cast of butterflies, birds, fish, beetles, frogs, lizards, mussels and more from every corner of the country.
But it also comes amid a backlash in Congress against the 37-year-old endangered species program. The Weekly Standard writes: Despite the growing Solyndra scandal, the Department of Energy approved $1 billion in new loans to green energy companies -- including a $737 million loan guarantee to a company known as SolarReserve:
SolarReserve LLC, a closely held renewable energy developer, received a $737 million U.S. Energy Department loan guarantee to build a solar-thermal project in Nevada.

The 110-megawatt Crescent Dunes project, near Tonopah, Nevada, will use the sun’s heat to create steam that drives a turbine, the agency said today in a e-mailed statement. SolarReserve is based in Santa Monica, California.
On SolarReserve's website is a list of "investment partners," including the "PCG Clean Energy & Technology Fund (East) LLC." The Ausin Statesman reports: Texas could be in the midst of a drought the history books have never seen, meaning water planners need to prepare for worse than what they've seen, state climatologist John Nielsen-Gammon said Thursday.
The current drought could last until 2020, because the region's climate is in the middle of a 20- to 40-year dry phase, Nielsen-Gammon said.
Water planners, including state agencies and river authorities, have long since made water plans based on the drought of record, a nearly 10-year dry spell in the 1940s and 1950s.

Washington Examiner writes: Maryland Gov. Martin O'Malley's plan to build one of the nation's first offshore wind farms off the coast of Ocean City was wisely put on hold last year by state legislators, who said they needed more time to study the proposal. Key questions about the centerpiece of O'Malley's environmental policy have finally been answered, and they don't help the cause.
Although the governor vowed in June 2010 that offshore wind energy would "create jobs for our workers and help stabilize utility costs for our families while increasing grid stability," it's clear he won't be able to deliver on any of those promises.
Like the solar panels manufactured by now bankrupt Solyndra, wind turbines depend on the vagaries of nature and thus are not reliable producers of electricity when it is needed. Which is why General Electric announced earlier this month that after pocketing $125 million in federal stimulus grants and contracts, it was retreating from the faltering offshore wind market due to lack of demand. GE, one of the world's leading manufacturers of direct-drive wind turbines, is laying off 40 employees at its ScanWind plant in Norway. O'Malley's claim that this heavily subsidized but still failing industry will create "green" jobs in Maryland is nothing but wishful thinking.

The NY Times reports: A Georgia company says it has overcome a major roadblock in turning agricultural waste into vehicle fuel and other useful chemicals by experimenting with a technology that treats the waste with compressed water heated to very high temperatures. 
If it works, the technology could reduce the nation’s reliance on oil imports for gasoline in favor of a cleaner-burning and less expensive source of energy. A company with a workable technology would have a guaranteed market, given that Congress has set quotas for the consumption of cellulosic fuel but so far, hardly any is being produced.

The Washington TImes reports: The State Department’s support of a controversial oil-pipeline project is putting pressure on the White House to move forward after three years, despite objections from environmentalists.
A series of public hearings concludes Friday on the Keystone XL pipeline, which would run from Canada’s oil sands in Alberta down through America’s midsection to the Texas Gulf Coast.
So far, the State Department has published reports in favor of the project, which is projected to create 20,000 jobs and reduce the nation’s dependence on overseas oil.
Still, it isn’t an easy decision for the Obama administration because it doesn’t want to disappoint its environmental supporters, who are opposed to the project. The UK Daily Mail reports: Rather overshadowed by events at the Conservative Party conference in Manchester last week was a line in George Osborne's speech which could mark the start of a long overdue political transformation in Britain.

One can fairly imagine how much easier life is about to get for the people of Hawaii, for instance, when they receive new federal guides on how to identify the 99 new native plants they must avoid trampling or trimming.
And though Americans will be initially alarmed to know that the giant Palouse earthworm of Idaho and the Utah Gila monster did not make the cut, the Obama administration is assuring us that all rejections are subject to court challenge.  Thank heavens!  It’s about time our underworked court system had something of substance to engage.

Redstate reports: Energy productivity isn’t the only thing that is hampered by laws governing so-called endangered species.  For decades, the Departments of Interior and Agriculture have encumbered border security operations with layers of environmental restrictions and regulations.  Additionally, the US Customs and Border Protection (CBP) has been forced to pay millions in taxpayer dollars, known as mitigation funds, to offset the “environmental effects” of their roads, fences, and surveillance towers in or near national parks and other federally owned lands.  Now, Rep. Rob Bishop is seeking to exempt the border patrol agents from these laws, so they can focus on their real job – protecting the border.
Bishop’s bill (H.R. 1505) prohibits the secretaries of Agriculture and Interior from impeding border security operations that are currently stymied by three dozen environmental regulations, including the Wilderness Act, National Environmental Policy Act, Clean Water Act, and the 1965 law known as the Solid Waste Disposal Act.  This bill allows CPB to construct roads and fences, use patrol vehicles, and set up monitoring equipment within on all federal lands within 100 miles of both the northern and southern borders. http://www.redstate.com/dhorowitz3/2011/10/11/green-border-security-is-as-effective-as-green-energy/
