Only Supremes Can Try the Arizona Immigration Law?

[Read it for yourself:] Article III, Sec. 2, clause 2 of the Constitution says:
In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the supreme Court shall have original Jurisdiction. In all the other Cases before mentioned, the supreme Court shall have appellate Jurisdiction…
According to the Canada Free Press attorney: “Original” jurisdiction means the power to conduct the “trial” of the case (as opposed to hearing an appeal from the judgment of a lower court). You all know quite well what a “trial” is - you see them all the time on TV shows: Perry Mason, Boston Legal, The Good Wife, etc. Witnesses testify and are cross-examined, etc.

The style of the Arizona case shows quite clearly that the named defendants are:
State of Arizona; and Janice K. Brewer,
Governor of the State of Arizona, in her
Official Capacity, Defendants.

Larry Klayman, founder of Judicial Watch and Freedom Watch USA, is bringing the complaint, alleging Kagan altered an official scientific report used as evidence by the Supreme Court to persuade the justices to overturn bans on partial-birth abortion. 
Kagan’s amendment dramatically changed the meaning of the ACOG statement, and court records show the statement was passed off on the Supreme Court as official scientific opinion, even though the ACOG’s panel of scientists never approved Kagan’s wording.

Maybe it's time, finally, to refudiate run-of-the-mill politicos and vote for someone as crazy as the rest of us. And never, never misunderestimate her.

Coming to us from The Australian, not our own media:  The US government secretly advised Scottish ministers it would be "far preferable" to free the Lockerbie bomber than jail him in Libya. Correspondence obtained by The Sunday Times reveals the Obama administration considered compassionate release more palatable than locking up Abdel Baset al-Megrahi in a Libyan prison. The intervention, which has angered US relatives of those who died in the attack, was made by Richard LeBaron, deputy head of the US embassy in London, a week before Megrahi was freed in August last year on grounds that he had terminal cancer.

A document, acquired by a well-placed US source, threatens to undermine US President Barack Obama’s claim last week that all Americans were “surprised, disappointed and angry” to learn of Megrahi’s release.
Scottish ministers viewed the level of US resistance to compassionate release as “half-hearted” and a sign it would be accepted.

Wikileaks Endangers our Afghan War Effort and the Lives of Informants There; and Obama's Priorities vs. his Problems

Judge NAPOLITANO, on Fox News Network: [The judge reported that while interviewing Mr. Assange, the founder of WikiLeaks, Mr. Assange stated that] he presented the documents - there were over 100,000 pages of them, to the White House weeks before they were released. He wouldn't give me an exact date.
Is there anything in here that can't be released, that you want redacted, that you don't want released that you questioned the authenticity of? The White House's response was silence. 

"The White House is trying to downplay this, but the White House should look at the vote of the House of Representatives yesterday in which a hundred Democrats voted against the supplemental appropriation to fund the war in Afghanistan," Napolitano explained. "Those are people in the President's own party. When did they take that vote? Three days after the WikiLeaks documents came out."
And apparently, the Obama administration made no such effort and couldn't have cared less, or that's the impression that Mr. Assange gave," Napolitano said.

CBS News is reporting that Afghan informants have been specifically named in the leaked documents, including the names of their close relatives and the villages in which they live. American forces will now have to scramble to protect these informants, since they will now be subject to Taliban revenge attacks. Some, no doubt, will be killed. Other Afghans will, thus, not have a very great incentive to cooperate with American and Coalition forces

Julian Assange, the founder of Wikileaks, has claimed that such sensitive information had been removed before the documents were posted. It is clear, though, that Assange is being less than accurate.
Assange's source in the US military has already been caught and will be prosecuted. The Swedish government allows Assange to publish with no legal sanction. The NYT writes that even as Obama continues his push to take over Americans' healthcare: Even as the new coalition government [In England] said it would make enormous cuts in the public sector, it initially promised to leave health care alone. But in one of its most surprising moves so far, it has done the opposite, proposing what would be the most radical reorganization of the National Health Service, as the system is called, since its inception in 1948.
Practical details of the plan are still sketchy. But its aim is clear: to shift control of England’s $160 billion annual health budget from a centralized bureaucracy to doctors at the local level. Under the plan, $100 billion to $125 billion a year would be meted out to general practitioners, who would use the money to buy services from hospitals and other health care providers.
The plan would also shrink the bureaucratic apparatus, in keeping with the government’s goal to effect $30 billion in “efficiency savings” in the health budget by 2014 and to reduce administrative costs by 45 percent. ABC News reports: At its peak last month, the oil slick was the size of Kansas, but it has been rapidly shrinking, now down to the size of New Hampshire.
Today, ABC News surveyed a marsh area and found none, and even on a flight out to the rig site Sunday with the Coast Guard, there was no oil to be seen.
Still, it doesn't mean that all the oil that gushed for weeks is gone. Thousands of small oil patches remain below the surface, but experts say an astonishing amount has disappeared, reabsorbed into the environment.

The Defense Department is unable to account for $8.7 billion of the $9.1 billion in Development Fund for Iraq monies it received for reconstruction in Iraq. This according to a study published today by the Special Inspector General for Iraq Reconstruction.
"This situation occurred because most DoD organizations receiving DFI (Development Fund for Iraq) funds did not establish the required Department of the Treasury accounts and no DoD organization was designated as the executive agent for managing the use of DFI funds," the report states.
The Special Inspector General for Iraq Reconstruction (SIGIR) finds that only one Defense organization actually set up the accounts required by the Treasury.
"The breakdown in controls left the funds vulnerable to inappropriate uses and undetected loss," SIGIR says.

Can diplomats field their own army? The State Department is laying plans to do precisely that in Iraq, in an unprecedented experiment that U.S. officials and some nervous lawmakers say could be risky. In little more than a year, State Department contractors in Iraq could be driving armored vehicles, flying aircraft, operating surveillance systems, even retrieving casualties if there are violent incidents and disposing of unexploded ordnance. Under the terms of a 2008 status of forces agreement, all U.S. troops must be out of Iraq by the end of 2011. 
Iraq remains a battle zone, and the American diplomats and other civilian government employees will need security. The U.S. military will be gone. Iraq's army and police, despite billions of dollars and years of American training, aren't yet capable of doing the job.

The Washington Post reports: A House ethics subcommittee announced Thursday that it found that Rep. Charles B. Rangel violated congressional ethics rules and that it will prepare for a trial, probably beginning in September. The panel is expected to make the details of his alleged violations public next Thursday.
Rangel (D-N.Y.) has been under the House ethics committee's microscope since early 2008 after it was reported that he may have used his House position to benefit his financial interests. From Yahoo News: The spokesman for the North Korean delegation to the talks, Ri Tong Il, repeated Pyongyang's denial of responsibility for the March sinking of the ship that killed 46 South Korean sailors and said the upcoming military drills were a violation of its sovereignty that harkened back to the days of 19th-century "gunboat diplomacy."
The exercises will be "another expression of hostile policy against" North Korea. "There will be physical response against the threat imposed by the United States militarily," Ri told reporters in Hanoi.  [This must be another example of how our relations with foreign countries has improve under Obama?]
Clinton responded by saying the U.S. is willing to meet and negotiate with the North, but that this type of threat only heightens tensions. She added that progress in the short term seems unlikely, given the circumstances.
"It is distressing when North Korea continues its threats and causes so much anxiety among its neighbors and the larger region," she told reporters. Fox News: The change in language was barely noticeable to the average citizen but political observers are raising red flags at the use of a new term "freedom of worship" by President Obama and Secretary Clinton as a replacement for the term freedom of religion. This shift happened between the President's speech in Cairo where he showcased America's freedom of religion and his appearance in November at a memorial for the victims of Fort Hood, where he specifically used the term "freedom of worship." From that point on, it has become the term of choice for the president and Clinton.
Everyone knows that religious Jews keep kosher, religious Quakers don't go to war, and religious Muslim women wear headscarves-yet "freedom of worship" would protect none of these acts of faith."
In the administration's defense, Carl Esbeck, professor of law at the University of Missouri, is quoted by Christianity Today as saying, "The softened message is probably meant for the Muslim world, said. Obama, seeking to repair relations fractured by 9/11, is telling Islamic countries that America is not interfering with their internal matters."
Let's be clear, however; language matters when it comes to defining freedoms and limits. A shift from freedom of religion to freedom of worship moves the dialog from the world stage into the physical confines of a church, temple, synagogue or mosque. Such limitations can unleash an unbridled initiative that we have only experienced in a mild way through actions determined to removal of roadside crosses, wearing of religious T-shirts and pro-life pins as well as any initiatives of evangelization. It also could exclude our right to raise our children in our faith, the right to religious education, literature or media, the right to raise funds or organize charitable activities and the right to express religious beliefs in the normal discourse of life. Revisiting My Pre-election Letter to the Editor - Refused by Local Paper

Prior to the last election, I tried for
4 weeks to have this letter run in our 
local paper. At the time, the paper
refused to run this because, according to
the Editor: "most of the facts that you
claim have been repeatedly shown as
inaccurate, or grossly misstate
associations and positions." Really? 
Let's revisit them. Ten Reasons I
Will Not Vote for Barack Obama
 
1)From years of mentoring by his “friend
Frank" (Marshall Davis), a member of 
the Communist Party of the USA - thru
friendships and associations with Chicago 
felon Tony Rezko, unrepentant Weather
Underground terrorist William Ayers, the group ACORN (for whom he was a lawyer and
 trainer; to whom his campaign has donated $800,000; and being the group who has 
been found to be registering thousands of fraudulent voters); and his 20 year 
membership in Reverend Wright's Black Liberation Theology Church, he doesn't have
the judgement to NOT associate with radicals. With whom will he likely fill his
cabinet?  [My three part series in my blog answers this one, in October 2009. This
letter should have said that Barack IS a radical with a radical agenda for
America.]
 2) He advocates income redistribution as Marxist Saul Alinsky prescribes “from 
those according to their ability, to those according to their need”.  This - even 
though the bottom 40% of Americans pay NO taxes, and the upper 5%, on whom he plans
to increase taxes, already pay 60% of all taxes.  It is these very people who buy 
products, spend money and employ the rest of us.  He wants to do this even knowing
that it will cause less money to go to the government, in the interest of 
“fairness”.  Taxes will be increased by another 10% on those who sell a home or 
stocks, as well as on those of us who have earned interest and dividends.  Taxes 
would be increased by 6.2% for those families earning over $102,000 because he 
plans to no longer cap Social Security taxes.  When he raises taxes on corporations
jobs will be shipped overseas where the taxes are much lower. [This was prior to 
Joe the Plumber, as well as the appointment, unconfirmed by Congress, of "rationing
King", our new man in charge of Medicare and Medicare.] 
3) While excoriating greedy CEOs, lobbyists and Republicans over the current 
financial meltdown, his associates Franklin Raines and Jim Johnson bilked Fannie
Mae of over $130 million as the company was going broke. In the last 3 years alone
this lobbyist-hating would-be President took the second largest amount of PAC funds
($130,000)from Fannie Mae, a total which is 49 times the amount that McCain was 
given over his lifetime. [During his administration, Obama has kept his hands off 
of government oversight or regulation of Fannie Mae and Freddie Mac, and has 
positioned the gov't to take over failing financial institutions.] 
 4) Americans give billions to poverty-plagued nations.  Barack plans to force us
to give another .7% of our Gross Domestic Product to the graft-ridden UN as part of
his Global Poverty Act. [His goal actually is to redistribute the hard won wealth
of Americans to the poor of the world; to give Amnesty (with critical voting 
rights) to millions of illegals; and to collapse our Capitalism system.] 
 5) He favors meeting with  evil enemy leaders without preconditions.  He has 
negotiated with Iraq, in violation of our Constitution, asking them to not
allow US soldiers to be sent home until after he is elected, so that he can get
the credit. [He now literally bows to our enemies and insults our allies. We have
learned that he hates Britain most likely because they imprisoned and daily 
tortured his Kenyan grandfather.]
 6) He would guarantee our loss in Iraq by telling enemies exactly when our troops 
will leave, regardless of conditions on the ground.  Al Qaeda will wait til we 
leave, take over the county, execute those Iraqis who fought for freedom, and 
exclaim victory over a weak USA. [I was wrong here, as it is in Afghanistan where
he is following this plan, putting in place as the Commander there a man he was
willing to trash as the Commander in Iraq.]  
 7) He has accused our troops of  “air-raiding villages and killing civilians” in
Afghanistan, fueling the world’s hatred and giving talking points to our enemies.
[He called our corpsmen - corpse-men. Now, during his Administration, we have
soldiers who must not shoot until shot upon and must never shoot is one civilian is
in the area, a rule which the enemy enjoys using to their own benefit.  More and 
more of our soldiers are being killed, but the media no longer berates the man in
office.] 
 8) Any criticism of Barack Obama has been and will continue to be falsely decried 
as racism, for he will not admit that it is his radical agenda which is in 
question.[This is shockingly true - in spades, no pun intended. I was right on 
the money on this one! Some in the Justice Department have been told they may not
prosecute any black man or woman, for that would be racist! Race relation in 
America have been set back decades] 
 9) Terrorist William Ayers placed Obama as Chairman of his Annenberg Challenge. 
Barack directed $50M to a project to specifically "radicalize" Chicago's public 
school education agenda. [He has demonstrated via his appointment to "safe school
czar, in particular, his radical agenda for children, including having been ok with
a male teacher's affair with a boy student, as well as distributing, at a seminar 
for middle and upper grade school children, pamphlets on the art of "fisting" (ask
a young person what this means). It is so sad that I have to be so graphic in order
to wake up those in self-imposed slumber.]
 10) He claims to want to reduce money in politics - yet his campaign has raised 
over $220M, some of it illegal,for use against McCain who, along with Obama,
pledged to use only public funds in his campaign. 
 And this is a Post-Racial Candidate?  Please.....I pray we are not this easily 
duped.  Our country is at stake.

Well - we WERE easily duped, partly because the Mainstream Media was complicit in
not asking tough questions and not questioning Barack's background, [as well as the
fact that it is easy to be complacent and not bother to vote, or to hate Bush so
much that all possible reason flew out the window for those who didn't want to see
the truth.]  Charlie Rose and Tom Brokaw, just days prior to the election, had the
gall to say, "You know, we really don't know anything about this man...." [Wasn't
that their job?] Those who refused to heed what we did know have had some time to
understand what a radical man can quickly do to his country, haven't they?
  In witnessing the ways in which Barack Obama seems to forget that he is half
white, as well as the dropping of charges against the Black Panthers who 
openly intimidated voters in Philadelphia, I recall Obama's discussion of Malcolm X 
during one of his speeches.  He said that he recalled that Malcolm X wished "that 
the white blood that ran thru him, there-by an act of violence, might somehow be 
expunged. The other race, he said, would always remain just that: menacing, alien 
and apart. I knew that for Malcolm X that wish would never be incidental. I knew 
as well that traveling down the road to self-respect, my own white blood would
never recede into mere abstraction."
 
What have we voters done to ourselves by voting for a man who reveres Malcolm X
and surrounds himself with only the most radical people?  Isn't it time to change

Fox News reports: The Obama administration is bracing for the first in a series of Washington Post articles said to focus in unprecedented detail on the government's spending on intelligence contractors. The intelligence community is warning that the article could blow the cover of contract companies doing top-secret work for the government. At the same time, a senior administration official acknowledged that the kind of wasteful spending expected to be spotlighted in the series is "troubling" and something the administration is trying to address. Two weeks ago, the White House informed the state of Oklahoma that it could expect no federal aid to help deal with the damage caused by recent flooding. There was no explanation, no expression of sympathy, no offer of alternatives.
Consider these actions. If anyone during the 2008 had implied, or even speculated, that Obama was capable of anything of the sort, he'd have been dismissed as a demagogue, a hater, even a lunatic. But today, after his abandonment of the state of Tennessee (also wracked by flooding), his betrayal of the Georgians, his pulling the rug out from under the Poles and Czechs, his dragging and cold response to the Gulf blowout, his insults to the UK, the GOP, the Supreme Court, Benjamin Netanyahu, and the Dalai Lama, it scarcely raises a shrug. That's Obama. That's how he acts -- with arrogance, superciliousness, and indifference. We can search the entire roster of American presidents, and we will not find a match. This is not the behavior of an elected chief executive; it's the conduct of a divine right monarch, and a pretty inadequate one as well.

Andrew Brietbart of Big Government: released a video of Shirley Sherrod, the USDA Georgia director of Rural Development, speaking at the NAACP Freedom Fund dinner in Georgia.
In her meandering speech to what appears to be an all-black audience, this federally appointed executive bureaucrat lays out in stark detail, that her federal duties are managed through the prism of race and class distinctions.
[...]Sherrod describes how she racially discriminates against a white farmer. She describes how she is torn over how much she will choose to help him. And, she admits that she doesn’t do everything she can for him, because he is white. Eventually, her basic humanity informs that this white man is poor and needs help. But she decides that he should get help from “one of his own kind”. She refers him to a white lawyer.

Due to the NEW media (that is Fox, ect, and we the people), the truth got out and here is the upshot, from Fox News : The Agriculture Department announced Monday, shortly after FoxNews.com published its initial report on the video, that Sherrod had resigned.

[Next up, before Democrats go home to "meet" their constituency, and more importantly, before they lose their seats in the November elections, comes news that an Energy bill is to be pushed thru the House.] The Hill reports: time is of the essence, as Reid has pledged to begin the energy debate the week of July 26. That would give Democrats two weeks to pass energy reform and confirm Supreme Court nominee Elena Kagan by the August recess, scheduled to begin Aug. 6.


The recess is scheduled to last five weeks, giving lawmakers facing tough reelections — including Reid — plenty of time to campaign. The House is scheduled to begin its recess on July 30.


Reid has warned that he may cut a week off the Senate recess if the legislative pace slows.

Google reports:  Earlier this week, Fox News reported that convicted felons voting illegally may have swung the pivotal 2008 Minnesota Senate race in favor of Al Franken.  It appears Democratic Secretary of State Mark Ritchie did little to combat this fraudulent activity.  
Mr. Ritchie took office in 2006 thanks in part to the significant financial backing of The Secretary of State Project, a liberal advocacy group funded largely by billionaire George Soros.  Mr. Soros' aim is to capture Secretary of State seats in swing states, establishing an electoral advantage for future elections.  Unfortunately, his plan worked to perfection in Minnesota, as Mr. Ritchie helped deliver the Democrat's 60th vote in the U.S. Senate.

What is Fascism; Peggy Noonan Dislikes Obama's Youth; and Is it A Demand or Is It a Tax?

AIP News writes: Fascism is really no more than a system where government, through agreements with the private sector, controls virtually all property and income indirectly
Prosperity and economic growth become the domain of government.  The philosophical aim is to eliminate recessions by eliminating robust growth -- the underlying philosophy being that if there is no boom, there will be no bust.  This system usually appeals to populations coming out of severe economic depressions and upheaval, as in pre-Nazi Germany during the period of the 1930s. 

The problem with the system is obvious:  property-owning democracy must take a back seat to the interests of the state.  And, by blurring the distinction between the private sector and the public sector, individual liberty can often be conditioned on complicity with state aims, as manifested in the private sector sphere.  Why else would German companies like Degesch be willing to supply the infamous Zyclon-B for use in the extermination of their fellow men if not conditioned upon the continued viability of the company and all employees concernedMoney talks, and when the state controls the powers of production directly or indirectly, it controls the livelihood of millions.  Human beings are capable of such immense evil in exchange for clothing and a full pantry.  
Fascism is, however, correctly associated with tyranny since nations that employ the tenets of fascism almost always transition from a republican or parliamentary form of government to some sort of personality cult usually centered on an economic "savior."
President Obama has done just this. 
Shortly after he claimed the right to fire the head of a private company, Obama realized he could claim the power to set wages in companies receiving bailout funds.  When these actions were successful, Obama realized he could then claim the power to set wages all across the economy, even venturing as far as attempting government mandates for company perks like private jets or club memberships

Similarly, when it was clear Congress would not object to Obama claiming the power to declare martial law, in direct violation of historic statute, Obama then contended that, in the event Congress would not cooperate, he would merely rule by decree.  This give-and-take approach has been wildly successful as a means of overcoming major constitutional obstacles to acquisitions of power.

All of Obama's actions have highly fascist overtones.  The fusion of government and the private sector can be observed most clearly in the recent Chicago-style shakedown of BP, wherein Obama forced a private sector company to set up a $20 billion slush fund to be controlled by his team of czars, criminally exceeding his constitutional authority.  Only days after it was clear that this action would not be met with legal challenge, Obama succeeded in passing a financial overhaul bill granting him the authority to seize healthy firms if he deemed them to be at risk, outside of normal bankruptcy procedures which exist expressly for that purposehttp://www.americanthinker.com/2010/07/american_jeopardy_what_is_fasc.html    [Scared yet?]
[This column reminds me that Obama's mantra is that, in his words, "recognizing that my fate remain tied up with their fates, that my individual salvation is not going to come about without a "collective salvation" for the country.   Unfortunately, I think that recognition requires that we make sacrifices and this country has not always been willing to make the sacrifices that are necessary to bring about a new day and a new age."  [In other words, he and his government must take wealth away from people in order to save people.  Words do mean something, as he says.  Billions of dollars of our money have for decades paid for those who have children in order to get more government hand-outs, for instance.  We are a generous nation, with our taxes and our donations.  It hasn't changed the outlook for those who will not use the free education they are given, who would rather have the government take care of them than go out and make a living, etc. The media were too enamored to inform the masses of what this man was saying and what his words would actually mean to our lives.  In this case "forewarned is forearmed" was overridden by "we want change and hope - and we don't care what kind."  Now we must have change - of an adult, America-loving

 Peggy Noonan [finally]writes:  All right, you know what I think people miss when they look at Washington and our political leadership? They miss old and august. They miss wise and weathered. They miss the presence of bruised and battered veterans of life who've absorbed its facts and lived to tell the tale.

Youth is supposed to bring vigor and vision. In general, however, I think we find in our modern political figures that what it really brings is need—for greatness, to be transformative, to leave a legacy. Such clamorous needs! How very boring they are, how puny and small, but how huge in their consequences.
What Mr. Obama needed the past 18 months was a wise man—more on that later—to offer counsel and perspective, a guy who just by walking into the room brings historical context.
Boring: that looks so good right now. Old, that looks so fresh, so new.
[I don't hate to say it - I told you so!  Where was this columnist when this view might have prevented an election of an empty suit to the White House?  She was singing the praises of this exciting man, at least after the election, that's where She lost her conservative mantle while worshiping at the feet of a man the media did not vet.]
