In ruling against President
Obama‘s health care law, federal Judge
Roger Vinson used
Mr. Obama‘s own position from the 2008 campaign against him, arguing that there are other ways to tackle health care short of requiring every American to purchase insurance.
“I note that in 2008, then-
Senator Obama supported a health care reform proposal that did not include an individual mandate because he was at that time strongly opposed to the idea, stating that ‘if a mandate was the solution, we can try that to solve homelessness by mandating everybody to buy a house,’” Judge
Vinson wrote in a footnote toward the end of the 78-page ruling Monday.
Judge
Vinson, a federal judge in the northern district of Florida, struck down the entire health care law as unconstitutional on Monday, though he is allowing the
Obama administration to continue to implement and enforce it while the government appeals his ruling.

Ben Johnson quotes Vinson: "I must reluctantly conclude that Congress exceeded the bounds of its authority in passing the Act with the individual mandate…Because the individual mandate is unconstitutional and not severable, the entire act must be declared void."
Johnson continues: Vinson, who was appointed by President Ronald Reagan, made clear his opposition to the bill came from its gross violation of the Constitution. Vinson wrote, “If Congress can penalize a passive individual for failing to engage in commerce, the enumeration of powers in the Constitution would have been in vain.” He concluded, “Congress must operate within the bounds established by the Constitution.”
[As I see it, Justice Sonia Sotomayor may recuse herself when the Supreme Court decides this issue, saying that she had influenced the law prior to being on the court. If that happens, it's entirely possible for the Supremes to vote 4-4. In that case, the law stands......]

abruptly disconnected its service on Monday.
"[A]nyone can tweet by simply leaving a voicemail on one of these international phone numbers ... and the service will instantly tweet the message using the hashtag #egypt,"

Newsbusters reports of Chuck Schumer's comments: They [Republicans] are getting wary because of the large debt we have, which we have to get down, but if they feel that people are willing to shut down the government, you could risk the credit markets really losing some confidence in the United States Treasury, and that could create a deeper recession than we had over the last several years -- God forbid, even a depression.
So I would urge my Republican colleagues, no matter how strongly they feel -- you know, we have three branches of government. We have a House. We have a Senate. We have a president. And all three of us are going to have to come together and give some, but it is playing with fire to risk the shutting down of the government, just as it is playing with fire to risk not paying the debt ceiling. [I ask you - should ANY Representative, Senator or President be so ignorant to say these words? Or is it Schumer's way of dismissing the Judiciary? He puts Palin's misfires to shame.]

ELBARADEI:You know, the Muslim Brotherhood has nothing to do with the Iranian model, has nothing to do with extremism, as we have seen it in Afghanistan and other places. The Muslim Brotherhood is a religiously conservative group. They are a minority in Egypt. They are not a majority of the Egyptian people, but they have a lot of credibility because all the other liberal parties have been smothered for 30 years.
